1. Introduction

This Privacy Policy describes how KinkzAI ("Provider," "we," "us," or "our") collects, uses, and discloses your information when you use the KinkzAI desktop application and website ("Service").

By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Service.

2. Information We Collect

We collect several types of information from and about users of our Service, including:

• Personal Information: This includes information that can be used to identify you, such as your email address (for account creation), and age

verification records (including country, subdivision, and assurance level). We do not collect your real name or physical address.

• Usage Data: This includes information about how you access and use the Service, such as timings and counts of usage events (e.g., when you log in, how often you use certain features). We do not record message text or character names in usage events.

• Account Information: This includes your subscription tier and renewal dates, and terms acceptance timestamps.

3. How We Collect Information

We collect information in the following ways:

• Directly from you: When you create an account, provide your email address, or go through the age verification process.

• Automatically as you use the Service: Through usage events that track your interaction with the application.

4. How We Use Your Information

We use the information we collect for various purposes, including:

• To provide, operate, and maintain our Service.

• To create and manage your account.

• To process your subscriptions and manage billing through Patreon.

• To verify your age and ensure compliance with legal requirements.

• To monitor and analyze usage and trends to improve the Service.

• To detect, prevent, and address technical issues.

• To enforce our Terms of Service.

• To comply with legal obligations, such as reporting illegal content to law enforcement.

5. Data Storage and Security

We are committed to protecting the security of your information. We implement reasonable security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information. However, no method of transmission over the Internet or method of electronic storage is 100% secure.

Offline Mode

In Offline Mode, the KinkzAI application runs entirely on your local device. Your characters, images, and conversations are stored exclusively in a folder on your disk. Text is generated by an AI model running on your own graphics card. No account is required for Offline Mode, and no data, including user-generated content, reaches our servers at any point. Consequently, we do not receive, store, or have access to any content generated or stored in Offline Mode.

Online Mode

When using Online Mode, you sign in to your account, and text is generated on GPU servers rented and managed by the Provider. Conversations and generated text pass through our API in transit for processing. However, we do not retain the

content of any message or conversation on our servers after processing; it is proxied to a GPU and the reply is returned to you. Character images, names, and descriptions remain on your local device in both modes and are never received, stored, or displayed by the Provider.

Data Stored on Our Servers

We store the following data on our servers:

• Login Data: Your email address and your account credentials, which are held and secured on our behalf by our database provider, Supabase. We do not have access to your password.

• Usage Events: Timings and counts of your interactions with the Service, tied to your user ID.

• Age-Verification Records: Information from ageverif.com, including country, subdivision, and assurance level.

• Terms Acceptance Timestamps: Records of when you accepted our Terms of Service.

• Subscription Information: Your subscription tier and renewal dates.

We do not store user-generated content (e.g., message text, character names, images) on our servers in either Offline or Online Mode.

6. Disclosure of Your Information

We may disclose your information in the following circumstances:

• With Your Consent: We may disclose your personal information for any purpose with your consent.

• For Legal Compliance: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency). This includes cooperating with law enforcement in investigations of illegal activities, such as child sexual abuse material (CSAM).

• To Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as age verification (ageverif.com) and billing (Patreon), our database and authentication provider (Supabase), and our email delivery provider (Resend). These service providers are obligated to protect your information and use it only for the purposes for

which it was disclosed.

• Business Transfers: In the event of a merger, acquisition, or asset sale, your personal information may be transferred. We will provide notice before your personal information is transferred and becomes subject to a different Privacy Policy.

7. Data Retention

We retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy, including for the purpose of satisfying any legal, accounting, or reporting requirements.

Usage events are retained for up to 12 months and are then deleted. They contain only timings and counts — never message text, character names, or anything describing what you did.

Age-verification records are retained for as long as your account is active, and afterwards only for as long as required to demonstrate compliance with age-verification obligations.

If you delete your account, your account data is removed. Some records may be retained where the law requires it.

8. Your Data Protection Rights

Depending on your location, you may have certain rights regarding your personal data, including:

• The right to access: You have the right to request copies of your personal data.

• The right to rectification: You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.

• The right to erasure: You have the right to request that we erase your personal data, under certain conditions.

• The right to restrict processing: You have the right to request that we restrict the processing of your personal data, under certain conditions.

• The right to object to processing: You have the right to object to our processing of your personal data, and to withdraw consent, under certain conditions.

• The right to data portability: You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

9. Third-Party Links

Our Service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

10. Children's Privacy

Our Service is not intended for individuals under the age of 18. We do not knowingly collect personally identifiable information from anyone under 18. If we become aware that we have collected personal data from children without verification of parental consent, we take steps to remove that information from our servers.

11. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "Effective Date" at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
