Content and Acceptable Use Policy

Effective 31 August 2026

This Content and Acceptable Use Policy (“Policy”) governs your use of KinkzAI. This Policy forms part of the KinkzAI Terms of Service (“Terms”).

Capitalized terms not defined in this Policy have the meanings given to them in the Terms.

KinkzAI is intended for adults and permits adult-oriented fictional roleplay. That does not mean that all content or conduct is permitted. The restrictions below apply regardless of whether content is fictional, generated using artificial intelligence, created or imported through the Desktop App, submitted through the Hosted Service, or stored only on your device.

If applicable law imposes stricter requirements than this Policy, you must comply with applicable law.

1. Adults Only

KinkzAI is exclusively for adults.

Every character that you create, import, configure, or intentionally interact with through KinkzAI must represent an adult who is at least 18 years old.

You must not use the Service to create, request, import, possess, generate, facilitate, or distribute sexual or exploitative content involving a person or character who:

• is under 18;
• is described, depicted, presented, or reasonably understood to be under 18;
• has an ambiguous or indeterminate age in a sexual context; or
• is an adult character being portrayed as a minor for purposes of sexual roleplay or sexualization.

Merely assigning an age of 18 or older to a character does not make the content permissible if the character is otherwise clearly presented as a minor.

This prohibition applies to actual, fictional, illustrated, animated, synthetic, AI-generated, and other representations of minors.

You must not attempt to use euphemisms, coded terminology, alternative spellings, character descriptions, prompts, or other methods to evade this prohibition.

2. Prohibited Sexual Content

The following content and conduct are prohibited.

2.1 Child sexual exploitation

The prohibition in Section 1 includes, without limitation:

• child sexual abuse material (“CSAM”);
• the sexual exploitation, grooming, trafficking, or abuse of a minor;
• sexualized depictions or descriptions of minors;
• requests or instructions for obtaining, creating, concealing, or distributing CSAM; and
• content intended to facilitate sexual contact or other sexual activity involving a minor.

There are no exceptions to these prohibitions.

2.2 Nonconsensual sexual content

You must not create, request, import, generate, or engage in sexual content involving conduct that is nonconsensual or in which a participant is unable to provide valid consent.

Prohibited content includes sexual activity involving a person or character who is:

• asleep or unconscious;
• drugged or intoxicated to the point of incapacity;
• hypnotized or otherwise depicted as lacking the ability to refuse;
• restrained, confined, abducted, or held against their will;
• coerced through threats, force, blackmail, extortion, abuse of authority, or other improper pressure; or
• otherwise incapable of freely consenting to the sexual activity.

2.3 Real people, impersonation, and deepfakes

You must not use the Service to create, request, import, generate, or distribute sexual or intimate content that depicts, impersonates, or is intended to depict an identifiable real person without that person’s valid consent.

You must not create or use nonconsensual intimate imagery, sexual deepfakes, synthetic sexual replicas, or other content falsely presenting an identifiable person as having participated in sexual or intimate conduct.

This restriction applies to private individuals and public figures.

You must not use a real person’s name, image, voice, likeness, or other identifying characteristics to evade this restriction.

2.4 Incest

You must not create, request, import, generate, or engage in incest or incest-themed sexual content.

2.5 Bestiality and animal cruelty

You must not create, request, import, generate, or engage in content involving:

• sexual activity between a person or human-like character and an animal;
• bestiality or zoophilia;
• sexualized animals; or
• animal abuse, torture, injury, or cruelty.

2.6 Sexual violence, extreme violence, necrophilia, and snuff

You must not create, request, import, generate, or engage in sexual content involving:

• murder or death;
• necrophilia;
• snuff or fantasy snuff;
• torture;
• mutilation or dismemberment;
• cannibalism;
• bloodletting;
• strangulation or hanging presented as extreme or potentially fatal violence;
• abduction or kidnapping in a sexual context; or
• other extreme physical violence, serious bodily injury, or death presented for sexual gratification.

2.7 Bodily waste

You must not create, request, import, generate, or engage in sexual content involving:

• urine or watersports;
• feces or scat; or
• the sexualized elimination or use of other excretory bodily waste.

2.8 Sexual activity involving intoxication or incapacity

You must not create, request, import, generate, or engage in sexual scenarios in which alcohol, drugs, medication, or another substance renders a participant incapable of providing valid consent or is used to facilitate sexual activity without valid consent.

This restriction applies regardless of whether the scenario is described as fictional or as having been agreed to in advance.

2.9 Prostitution and commercial sexual services

You must not use the Service to depict, promote, solicit, arrange, facilitate, or roleplay prostitution, escorting, or the buying or selling of sexual services.

You must not use the Service to facilitate sex trafficking, sexual exploitation, or another unlawful commercial sexual activity.

2.10 Polygamy

You must not use the Service to create, request, import, generate, or engage in polygamy, bigamy, or plural-marriage scenarios.

3. Suicide, Self-Harm, and Crisis Situations

Discussing distress, suicidal thoughts, self-harm, or other mental-health concerns does not by itself violate this Policy.

You must not use the Service to request, create, or facilitate content that:

• encourages, promotes, celebrates, or romanticizes suicide or self-harm;
• provides actionable instructions for suicide or serious self-harm;
• encourages another person to injure or kill themselves;
• assists with planning or concealing suicide or serious self-harm; or
• attempts to defeat, manipulate, or circumvent a crisis-response or safety feature.

KinkzAI is not an emergency or mental-health service. The Hosted Service uses automated safety measures designed to identify certain expressions of suicidal ideation, suicide, serious self-harm, dangerous eating-disorder behavior, and related crisis situations and to provide or direct users to appropriate crisis-resource information.

4. Hate, Harassment, and Harm to Others

You must not use the Service to:

• promote or encourage hatred, violence, discrimination, or dehumanization based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, gender identity, disability, or another characteristic protected by applicable law;
• threaten, stalk, harass, intimidate, or abuse a real person;
• encourage or facilitate violence or serious physical harm against a real person or group;
• publish or solicit private identifying information for purposes of harassment or harm;
• blackmail, extort, or coerce another person; or
• organize or facilitate real-world abuse or exploitation.

5. Illegal Activity and Dangerous Instructions

You must not use the Service to plan, facilitate, encourage, or obtain actionable assistance for illegal activity.

Prohibited uses include requests intended to facilitate:

• weapons or explosives offenses;
• violent crime;
• human trafficking or sexual exploitation;
• fraud, identity theft, theft, or financial crime;
• unauthorized access to computers, accounts, or networks;
• malware, credential theft, phishing, or other malicious cyber activity;
• unlawful drug production, trafficking, or distribution;
• evasion of law enforcement or concealment of serious criminal activity; or
• another crime or unlawful act.

This section does not prohibit ordinary fictional discussion, news, education, or general information that does not meaningfully facilitate unlawful conduct.

6. Professional Advice and Professional Impersonation

KinkzAI characters are fictional AI characters. Nightcloud does not present KinkzAI characters as licensed medical, mental-health, legal, financial, or other professionals.

AI-generated responses are for entertainment and roleplay and are not a substitute for professional advice, diagnosis, treatment, or services.

You should not rely on a KinkzAI character for medical, mental-health, psychological, legal, financial, investment, tax, accounting, emergency, or other professional advice or services.

You must not configure, describe, or use Local Content in a manner that falsely represents a KinkzAI character as an actual licensed or qualified professional or that is intended to deceive another person into believing that the character is a real professional.

Nothing in this section prohibits a user from discussing personal concerns or asking general questions. Users experiencing an emergency or crisis should contact an appropriate professional or emergency service.

7. Your Content; Intellectual Property, Privacy, and Publicity Rights

7.1 Rights of others

You must not use the Service in a manner that infringes or misappropriates another person’s:

• copyright;
• trademark or service mark;
• patent;
• trade secret;
• right of publicity;
• privacy right; or
• other intellectual-property, proprietary, or personal right.

7.2 Local Content representations

You are responsible for Local Content that you create, import, possess, or use with the Desktop App.

By creating or importing Local Content, you represent that:

• you have all rights, licenses, permissions, and consents necessary to possess and use that Local Content;
• the Local Content does not depict, describe, or sexualize a person under 18;
• any sexual or intimate depiction of an identifiable real person is used only with that person’s valid consent;
• your use of any name, image, voice, likeness, character, artwork, audio file, or other material does not violate another person’s intellectual-property, privacy, publicity, or other rights; and
• the Local Content and your use of it comply with this Policy and applicable law.

These representations apply even when Local Content remains entirely on your device and is never transmitted to Nightcloud.

7.3 Hosted Content

You are responsible for Hosted Content that you submit through the Hosted Service.

You represent that you have the rights and permissions necessary to submit and use Hosted Content and that your Hosted Content complies with this Policy, the Terms, and applicable law.

8. Fraud, Deception, and Impersonation

You must not use the Service to:

• impersonate another person for purposes of fraud, harassment, deception, or harm;
• create fraudulent documents, credentials, accounts, or identity information;
• conduct scams or deceptive commercial activity;
• falsely suggest that Nightcloud or KinkzAI sponsors, endorses, or is affiliated with a person, product, service, or activity; or
• misrepresent AI-generated content as an authentic communication or statement from a real person where doing so is deceptive or harmful.

9. Security, Abuse, and Ban Evasion

You must not:

• introduce malware, viruses, worms, malicious code, or other harmful technology into the Service;
• attempt to obtain unauthorized access to an account, server, network, database, system, or other resource;
• probe, scan, or test the vulnerability of the Service without our written authorization;
• interfere with or disrupt the operation or security of the Service;
• scrape, harvest, or systematically extract content or data except as expressly permitted by us;
• circumvent message limits, subscription controls, authentication requirements, age-verification measures, geographic restrictions, or other technical restrictions;
• remove, alter, obscure, defeat, or circumvent an AI disclosure, machine-readable marking, metadata, safety mechanism, or other AI-transparency measure;
• use automated systems to access the Hosted Service in a manner that exceeds or circumvents normal human use or plan limits; or
• create or use another account to evade a suspension, restriction, or termination imposed because of a violation of this Policy or the Terms without our permission.

10. Circumvention of Content and Safety Measures

You must not attempt to bypass or defeat a content restriction or safety measure through prompt injection, jailbreaks, encoded instructions, euphemisms, character instructions, imported character files, user-supplied AI models, or another method.

The fact that a user-supplied model, Local Content, or other component is technically capable of producing prohibited content does not make that content permissible under this Policy.

Whether prohibited output was unsolicited and was not requested or intentionally elicited by you may be considered when we determine whether a violation occurred.

If the Service produces content prohibited by this Policy, you must not intentionally continue prompting for that content or distribute it and should report the output to admin@kinkzai.com.

11. Local and Offline Use

The Desktop App may permit Local Content and AI processing to remain entirely on your device.

Nightcloud does not routinely monitor or inspect Local Content that remains on your device and does not receive that content merely because you use the Desktop App, unless a feature expressly tells you otherwise.

That does not exempt Local Content or offline use from this Policy or applicable law.

You remain responsible for Local Content, user-supplied AI models, and your use of the Desktop App.

12. Hosted Service

The Hosted Service processes Hosted Content transiently to provide AI-generated responses. As described in the Terms and Privacy Policy, Nightcloud does not maintain a server-side conversation history as part of its ordinary operation of the Service.

The Hosted Service uses system-level instructions and other technical controls designed to prevent or redirect prohibited requests. Those measures may not identify every violation and do not change your obligation to comply with this Policy.

You must not attempt to disable, manipulate, or circumvent those measures. Additional information concerning Nightcloud’s screening controls appears in our Pre-Screening and Post-Screening Policy.

13. Enforcement

We may take action if we reasonably determine, based on information available to us, that you have violated this Policy.

Depending on the nature and severity of the violation, we may:

• decline or block a request or generation;
• restrict a feature;
• warn you;
• suspend or terminate your account or access to the Service;
• preserve information when required by applicable law or legal process;
• report apparent illegal activity when required by applicable law; or
• take other action reasonably necessary to protect Nightcloud, the Service, our service providers, payment processors, card networks, users, or third parties.

We may immediately suspend or terminate access for serious violations, including suspected child sexual exploitation, nonconsensual intimate imagery, trafficking, fraud, or attempts to circumvent age-verification or safety controls.

Any refund rights following suspension or termination are governed by the Terms and our Billing, Cancellation, and Refund Policy.

Nothing in this Policy requires Nightcloud to monitor Local Content that remains solely on your device.

14. Reporting Content, Conduct, or Other Complaints

You may report content, conduct, or other activity that you believe violates this Policy, applicable law, or your rights by emailing:

Please provide enough information for us to identify and evaluate the complaint, including the nature of the complaint and any information reasonably available to you concerning the relevant content or activity.

If your complaint concerns content that you believe depicts or identifies you without your consent, please identify the content and explain your connection to it.

Nightcloud reviews and resolves complaints in accordance with our Complaints and Appeals Policy, which governs the applicable procedures and response periods.

You must not use the Service to retaliate against, threaten, intimidate, harass, blackmail, extort, or otherwise harm a person because that person submitted a good-faith complaint or report, sought assistance, or cooperated with an investigation.

Resolution may include removing or disabling content within our control, restricting or terminating an account, determining that the reported activity does not violate this Policy, requesting corrective action, making a legally required report, or determining that the reported content is not within Nightcloud’s possession or control.

If we determine that content within our control is illegal or violates this Policy, we will disable or remove it promptly and take any other action required by applicable law.

Because Nightcloud does not maintain a server-side conversation history and Local Content ordinarily remains on a user’s device, we may be unable to inspect, disable, or remove content that is not within our possession or control.

15. Reports Involving Child Sexual Exploitation

If you become aware of content or activity that appears to involve CSAM or the sexual exploitation of a person under 18, you may report it to us at:

We will treat reports concerning suspected child sexual exploitation as priority matters.

If Nightcloud obtains actual knowledge of apparent CSAM or other conduct that applicable law requires us to report, we will make the required report and comply with applicable preservation obligations.

In the United States, suspected child sexual exploitation may also be reported to the National Center for Missing & Exploited Children’s CyberTipline.

If you are outside the United States, you may also report suspected child sexual exploitation to local law enforcement or the appropriate child-protection reporting service in your country.

16. Fictional, Private, and Local Content

A category of content or conduct prohibited by this Policy does not become permissible merely because:

• the character is fictional;
• the content is generated by artificial intelligence;
• the content is intended as fantasy or roleplay;
• no other KinkzAI user can see it;
• the content remains on your device;
• you use a third-party AI model with the Desktop App; or
• the content or conduct would otherwise be lawful where you are located.

KinkzAI may impose content restrictions that are more restrictive than applicable law, including restrictions required by our payment processors, card networks, service providers, or business policies.

17. Review of Enforcement Decisions

If we suspend or terminate your account or materially restrict your access because of an alleged violation of this Policy, you may request review of that decision by emailing:

Your request should identify the account and explain why you believe the enforcement decision should be reconsidered.

We may uphold, modify, or reverse an enforcement decision after reviewing the information reasonably available to us.

This review process does not limit our ability to maintain an immediate suspension or restriction while a review is pending when we determine that continued access may present a legal, safety, security, payment-processing, or other material risk.

Nothing in this section requires us to reinstate an account or feature when continued access would violate applicable law or the requirements of a payment processor, card network, or necessary service provider.

18. Changes to This Policy

We may modify this Policy from time to time.

Material changes will apply prospectively and will be communicated as required by applicable law.

The date at the top of this Policy identifies when it was last updated.
