Content Moderation Policy

This Content Moderation Policy explains how Nightcloud Interactive LLC (“Nightcloud,” “we,” “us,” or “our”) applies and enforces content standards in connection with KinkzAI.

KinkzAI is an adult AI companion and roleplay service. It is not a public user-generated-content platform. KinkzAI does not currently provide a public gallery, marketplace, social network, or user-to-user content-sharing service. Because the Service includes both hosted AI interactions and locally operated desktop functionality, the moderation measures available to Nightcloud differ depending on how content is created, processed, or stored.

This Policy should be read together with our Terms of Service, Content and Acceptable Use Policy, Complaints and Appeals Policy, Age Verification Policy, Anti-Human Trafficking and Exploitation Policy, AI Companion Safety Protocol, and Pre-Screening and Post-Screening Policy.

Capitalized terms not defined in this Policy have the meanings given to them in our Terms of Service.

1. Our Content Standards

Nightcloud applies the content and conduct standards set out in our Content and Acceptable Use Policy. That policy is the primary statement of the categories of content and conduct prohibited through KinkzAI.

Those standards address, among other matters, minors and child sexual exploitation, nonconsensual sexual content, unauthorized sexual depictions of identifiable real people, prohibited categories of adult sexual content, human trafficking and commercial sexual exploitation, suicide and self-harm, hate and harassment, illegal activity, infringement of third-party rights, fraud and harmful impersonation, and attempts to circumvent KinkzAI’s protective measures.

Our content standards may be more restrictive than applicable law where appropriate to comply with card-network rules, payment-processor requirements, service-provider requirements, safety considerations, or Nightcloud’s business policies.

If this Policy and the Content and Acceptable Use Policy describe the same prohibited content or conduct differently, the Content and Acceptable Use Policy controls as to what users may or may not do.

2. How Content Moderation Works on KinkzAI

KinkzAI uses different moderation measures for KinkzAI-supplied content, Hosted Service interactions, and Local Content.

Our moderation approach combines preventive controls, technical safeguards, pre-release review of KinkzAI-supplied materials, complaint-based review, and account enforcement.

Because artificial-intelligence systems are probabilistic, no automated control can guarantee that prohibited content will never be generated. Users remain responsible for complying with the Content and Acceptable Use Policy even where an automated safeguard does not prevent a particular response.

3. KinkzAI-Supplied Characters and Artwork

KinkzAI-supplied character artwork consists of fixed artwork prepared in advance rather than images generated by users through the Service.

Nightcloud reviews KinkzAI-supplied character artwork before making it available through KinkzAI.

KinkzAI-supplied characters and artwork are intended to depict fictional adults and are not intended to depict identifiable real people.

If Nightcloud determines that KinkzAI-supplied content violates applicable law, the Content and Acceptable Use Policy, payment-processor or card-network requirements, or Nightcloud’s content standards, Nightcloud may modify, disable, or remove that content.

4. Hosted AI Interactions

The Hosted Service uses system-level instructions and other technical controls designed to prevent or redirect requests for content prohibited by the Content and Acceptable Use Policy.

Those controls apply to hosted AI generation and are not intended to be disabled or overridden through user prompts, character instructions, jailbreaks, prompt injection, encoded instructions, or similar methods.

Depending on the nature of a request, the Hosted Service may:

• refuse to generate a response;
• redirect an interaction;
• provide a limited response that does not facilitate prohibited activity;
• provide safety or crisis-resource information where applicable; or
• take another automated action designed to enforce applicable content or safety rules.

Automated controls may not identify every prohibited request or prevent every prohibited output.

5. Transient Processing and No Conversation Archive

Hosted Content is processed transiently to generate responses.

Nightcloud does not maintain a server-side conversation history as part of its ordinary operation of the Service, and its ordinary Service logging is not designed to maintain a record of Hosted Content.

As a result, Nightcloud generally cannot retrospectively review a user’s complete Hosted Service conversation after the interaction has ended.

If a user submits a complaint or report concerning an AI-generated response, Nightcloud may review information supplied with the report, such as copied text, screenshots, account information, technical information, or other evidence reasonably available to Nightcloud.

Information submitted separately as part of a report or complaint may be retained as reasonably necessary to investigate and resolve the matter, comply with legal obligations, document enforcement activity, or protect Nightcloud and its users.

6. Local and Offline Content

The Desktop App may permit users to create, import, or use Local Content and third-party AI models on their own devices.

Nightcloud does not routinely monitor or inspect Local Content that remains on a user’s device and does not receive that content merely because the user operates the Desktop App, unless a particular feature expressly provides otherwise.

Nightcloud therefore may be unable to detect, inspect, block, modify, or remove Local Content that remains entirely on a user’s device.

The absence of monitoring does not make prohibited content permissible. Local Content and use of the Desktop App remain subject to the Terms of Service, Content and Acceptable Use Policy, and applicable law.

Nightcloud may take account-level action based on reliable information establishing that a user has violated those requirements, even if Nightcloud does not possess the underlying Local Content.

7. User-Supplied AI Models

The Desktop App may permit a user to operate an AI model obtained independently from Nightcloud.

Nightcloud does not control the output capabilities, training, safety characteristics, or behavior of a user-supplied AI model merely because the Desktop App is technically capable of interacting with it.

Users remain responsible for complying with the Content and Acceptable Use Policy when using a user-supplied AI model with the Desktop App.

Technical capability does not authorize a user to create or use content prohibited by KinkzAI’s policies or applicable law.

8. Priority Safety and Illegal-Content Categories

Nightcloud gives priority handling to reports or information involving serious safety or legal concerns, including:

• actual or suspected CSAM or child sexual exploitation;
• human trafficking or sexual exploitation;
• nonconsensual intimate imagery or sexual deepfakes;
• credible threats of serious real-world violence;
• apparent illegal activity requiring action by Nightcloud; and
• other matters requiring expedited action under applicable law, card-network rules, or payment-processor requirements.

Priority handling may include immediate restriction of an account or feature while Nightcloud investigates the matter.

9. Child Sexual Abuse Material and Exploitation

KinkzAI prohibits CSAM and all sexual exploitation or sexualization of persons under 18.

Nightcloud may immediately restrict or terminate an account based on information reasonably indicating involvement with CSAM or child sexual exploitation.

If Nightcloud obtains actual knowledge of apparent CSAM or other conduct that applicable law requires Nightcloud to report, Nightcloud will make the required report and comply with applicable preservation obligations.

In the United States, required reports may include reports to the National Center for Missing & Exploited Children.

Nightcloud will cooperate with valid legal process concerning child sexual exploitation and will preserve information when required by applicable law or legal process.

10. Nonconsensual Intimate Imagery and Sexual Deepfakes

KinkzAI prohibits nonconsensual intimate imagery, sexual deepfakes, synthetic sexual replicas, and other sexual or intimate content falsely presenting an identifiable real person as participating in sexual conduct without that person’s valid consent.

KinkzAI does not currently provide functionality for users to publicly upload, publish, or share user-generated images or videos through the Service.

Nightcloud nevertheless accepts reports and removal requests concerning suspected nonconsensual intimate imagery or sexual deepfakes associated with KinkzAI and gives those matters priority handling.

Our Complaints and Appeals Policy describes the process for submitting a nonconsensual-intimate-imagery removal request and the information that should accompany the request.

If applicable law requires Nightcloud to remove or disable qualifying content within a particular period, Nightcloud will comply with that deadline, including any requirement to address known identical copies within the applicable period.

Nothing in this Policy limits any shorter response, disabling, or removal period required by applicable law.

11. Human Trafficking and Sexual Exploitation

The Content and Acceptable Use Policy prohibits using KinkzAI to recruit, advertise, solicit, arrange, promote, or facilitate human trafficking, sexual exploitation, prostitution, or unlawful commercial sexual activity.

Nightcloud treats reports involving suspected human trafficking or sexual exploitation as priority matters.

When Nightcloud receives information reasonably indicating trafficking or exploitation associated with the Service, Nightcloud may restrict or terminate access, preserve information when required, cooperate with valid legal process, make reports required by applicable law, and take other appropriate action based on the information available to it.

12. Suicide and Self-Harm Safety

KinkzAI is not an emergency, crisis-intervention, or mental-health service.

The Hosted Service uses automated measures designed to identify certain expressions of suicidal ideation, suicide, serious self-harm, dangerous eating-disorder behavior, and related crisis situations and to provide or direct users to appropriate crisis-resource information.

Those measures are separate from ordinary content moderation and may not identify every crisis or interpret every statement correctly.

13. Age-Related Controls

KinkzAI is exclusively for adults who satisfy the applicable minimum-age requirements for access to the Service.

Age verification and age-assurance controls operate separately from content moderation. A user’s successful completion of age verification does not permit content prohibited by the Content and Acceptable Use Policy.

Nightcloud may restrict or terminate access if it cannot verify a user’s eligibility or reasonably determines that a user has attempted to bypass or manipulate an age-verification requirement.

If Nightcloud determines that a user does not satisfy the applicable minimum-age requirement for the Service, Nightcloud will promptly restrict or terminate that user’s access. Information associated with the account will be handled in accordance with our Privacy Policy, applicable retention requirements, legal obligations, and any applicable preservation requirement.

14. Reports and Complaints

Users, affected persons, rights holders, and other persons may report suspected violations of KinkzAI policies, illegal content, or other content-related concerns by contacting:

Nightcloud reviews and resolves complaints in accordance with its Complaints and Appeals Policy, which governs the applicable procedures and response periods.

Certain matters, including suspected CSAM, human trafficking or sexual exploitation, nonconsensual intimate imagery, and credible threats of serious real-world harm, receive priority handling and may require immediate action before the complaint is resolved.

Because Nightcloud does not maintain a server-side conversation history and generally does not possess Local Content stored on users’ devices, persons submitting reports should provide sufficient information and supporting material to permit Nightcloud to evaluate the complaint.

Our Complaints and Appeals Policy describes the complaint process, potential resolutions, and review of enforcement decisions.

15. Moderation and Enforcement Actions

When Nightcloud reasonably determines, based on information available to it, that content or conduct violates applicable law or KinkzAI’s policies, Nightcloud may take one or more actions appropriate to the circumstances, including:

• blocking or declining an AI generation;
• modifying or disabling a KinkzAI-supplied character, artwork, or other content;
• restricting a feature or account;
• issuing a warning;
• suspending or terminating an account;
• preventing a terminated user from evading enforcement through another account;
• preserving information when required by applicable law or legal process;
• making a report required by applicable law;
• cooperating with valid legal process; or
• taking other action reasonably necessary to protect Nightcloud, users, service providers, payment processors, card networks, or third parties.

The type of action taken depends on factors such as the seriousness of the violation, available evidence, whether the violation appears intentional or repeated, legal requirements, and risks to users or third parties.

Serious violations may result in immediate suspension or termination without a prior warning.

Any refund rights following suspension or termination are governed by the Terms of Service and our Billing, Cancellation, and Refund Policy.

16. Unsolicited AI Output

Artificial-intelligence systems can produce unexpected output.

When Nightcloud evaluates a reported policy violation, it may consider whether prohibited output was unsolicited and was not requested or intentionally elicited by the user.

If the Service produces content prohibited by the Content and Acceptable Use Policy, the user must not intentionally continue prompting for that content or distribute it.

Users should report prohibited AI-generated output to admin@kinkzai.com so that Nightcloud can evaluate whether technical, safety, or policy changes are appropriate.

17. Appeals and Review

A user whose account is suspended or terminated, or whose access is materially restricted because of an alleged policy violation, may request review in accordance with our Complaints and Appeals Policy.

Nightcloud may maintain an immediate suspension or restriction while a review is pending when continued access may present a legal, safety, security, payment-processing, or other material risk.

An appeal does not require Nightcloud to restore access when restoration would violate applicable law or a binding requirement imposed by a card network, payment processor, or necessary service provider.

18. Records and Preservation

Nightcloud may maintain records concerning complaints, investigations, moderation decisions, enforcement actions, and related communications for legitimate operational, legal, compliance, fraud-prevention, and payment-processing purposes.

This does not mean that Nightcloud maintains a server-side archive of Hosted Service conversations or routinely collects Local Content.

When applicable law, valid legal process, or a preservation obligation requires Nightcloud to preserve information within its possession or control, Nightcloud will preserve that information as required.

Our Privacy Policy provides additional information about the collection, use, retention, and disclosure of personal information.

19. Limitations of Moderation

Content moderation cannot prevent every prohibited request, AI-generated response, or misuse of the Service.

Nightcloud’s ability to investigate or take action depends on the nature of the Service, the information available to Nightcloud, and whether relevant content is within Nightcloud’s possession or control.

The existence of an automated safeguard, manual review procedure, reporting process, or other moderation measure does not guarantee that every violation will be identified or prevented.

Users remain responsible for complying with the Terms of Service, Content and Acceptable Use Policy, and applicable law.

20. Changes to This Policy

Nightcloud may modify this Policy from time to time to address changes in the Service, applicable law, card-network or payment-processor requirements, safety practices, or our moderation procedures.

Material changes will apply prospectively and will be communicated as required by applicable law.

The date at the top of this Policy identifies when it was last updated.
