Anti-Human Trafficking and Exploitation Policy

Nightcloud Interactive LLC (“Nightcloud,” “we,” “us,” or “our”) maintains a zero-tolerance policy concerning human trafficking, sex trafficking, child sexual exploitation, forced labor, coercion, and other exploitation in connection with KinkzAI.

KinkzAI is an adult AI companion and roleplay service. Its current design does not include user-to-user messaging, user-to-user payments, a creator marketplace, or functionality designed to arrange meetings or commercial sexual activity between users. These characteristics substantially limit the ways in which KinkzAI could be used to facilitate real-world trafficking or exploitation, but they do not eliminate the need for strong prohibitions and procedures for responding to suspected abuse.

This Policy explains Nightcloud’s standards, preventative controls, reporting procedures, and enforcement practices concerning human trafficking and related exploitation.

This Policy should be read together with our Terms of Service, Content and Acceptable Use Policy, Content Moderation Policy, Complaints and Appeals Policy, Age Verification Policy, AI Companion Safety Protocol, and Law Enforcement and Government Request Guidelines.

Capitalized terms not defined in this Policy have the meanings given to them in our Terms of Service.

1. Zero-Tolerance Standard

Nightcloud prohibits the use of KinkzAI to engage in, promote, facilitate, assist, conceal, encourage, or profit from:

• human trafficking;
• sex trafficking;
• forced labor or involuntary servitude;
• child sexual exploitation;
• commercial sexual exploitation;
• prostitution, escorting, or unlawful commercial sexual services;
• forced or coerced sexual activity;
• grooming or sexual exploitation of a minor;
• sextortion, sexual blackmail, or sexual extortion; or
• other conduct involving the unlawful coercion, control, or exploitation of another person.

These prohibitions apply regardless of whether conduct occurs entirely through the Service, involves conduct outside KinkzAI, or uses KinkzAI as one part of a broader course of activity.

Nightcloud’s zero-tolerance standard describes the conduct prohibited by this Policy. The particular enforcement action taken in response to a report or violation depends on the available evidence, the nature and severity of the conduct, applicable law, and other relevant circumstances.

2. Prohibited Trafficking-Related Conduct

The Content and Acceptable Use Policy contains KinkzAI’s primary rules governing prohibited content and conduct.

Without limiting that policy, you must not use KinkzAI to:

• recruit or attempt to recruit another person for human trafficking, sex trafficking, forced labor, prostitution, escorting, commercial sexual exploitation, or unlawful sexual services;
• advertise, solicit, arrange, facilitate, coordinate, or promote access to another person for commercial sexual activity;
• use force, fraud, coercion, threats, intimidation, blackmail, extortion, abuse of authority, or deception to cause or attempt to cause another person to engage in sexual activity, labor, or services;
• traffic, transport, harbor, control, or exploit another person;
• unlawfully profit from or receive a benefit from the trafficking or exploitation of another person;
• offer or solicit money, gifts, lodging, transportation, employment, drugs, services, or another benefit as part of trafficking, exploitation, or unlawful commercial sexual activity;
• exploit another person’s financial dependence, immigration status, housing insecurity, addiction, disability, age, isolation, or other vulnerability;
• confiscate, control, withhold, or threaten to withhold another person’s money, identification documents, communications, devices, transportation, housing, or other resources for exploitative purposes;
• threaten to disclose intimate material, private information, immigration information, criminal history, sexual history, sexual orientation, gender identity, or other sensitive information to coerce or exploit another person;
• groom, sexually solicit, traffic, exploit, or attempt to exploit a person under 18;
• create, request, solicit, possess, distribute, or facilitate access to child sexual abuse material or other sexual content involving a minor;
• provide actionable instructions intended to facilitate trafficking, exploitation, coercion, or unlawful commercial sexual activity;
• use coded terminology, euphemisms, prompts, character instructions, imported files, user-supplied AI models, or other techniques to evade KinkzAI’s trafficking or exploitation restrictions; or
• assist, encourage, conceal, coordinate, or knowingly participate in any conduct described above.

3. Minors

KinkzAI is exclusively for adults who satisfy the applicable minimum-age requirements for the Service.

Any sexual exploitation or commercial sexual activity involving a person under 18 is prohibited.

You must not use KinkzAI to recruit, solicit, groom, entice, exploit, traffic, sexualize, or facilitate the abuse of a minor.

You must not create, request, import, possess, generate, or distribute child sexual abuse material (“CSAM”) or other sexual or exploitative content involving a minor or a person reasonably understood to be a minor.

Reports involving suspected child sexual exploitation receive priority handling.

If Nightcloud obtains actual knowledge of apparent CSAM or other conduct that applicable law requires us to report, Nightcloud will make the required report and comply with applicable preservation obligations.

4. Consent, Coercion, and Exploitation

Valid consent must be voluntary and legally effective.

Consent is not valid where it results from force, fraud, coercion, threats, intimidation, blackmail, extortion, trafficking, exploitation, incapacity, abuse of authority, or another circumstance that prevents a person from freely consenting.

A person’s prior consent to sexual activity, communication, content creation, content distribution, employment, travel, or another activity does not authorize subsequent trafficking, exploitation, coercion, abuse, or nonconsensual conduct.

The fact that content or conduct is fictional or described as roleplay does not make real-world trafficking, exploitation, recruitment, solicitation, or facilitation permissible.

5. Product Design and Preventative Controls

KinkzAI’s current design limits several types of activity commonly associated with online trafficking or commercial sexual exploitation.

KinkzAI does not currently provide:

• public user profiles or public user-generated-content pages;
• a public character or content marketplace;
• user-to-user messaging;
• payments or tips from one user to another;
• a system for creators or other users to sell sexual content or services;
• functionality designed to advertise or arrange in-person sexual services or meetings; or
• functionality permitting users to publicly upload or share user-generated images or videos through KinkzAI.

Before introducing functionality that materially changes this risk profile, Nightcloud will review this Policy and its related anti-trafficking controls and update them as appropriate.

6. Age-Verification Controls

Nightcloud uses age-verification or age-assurance measures as described in the Terms of Service and Age Verification Policy.

Users must not circumvent, manipulate, defeat, or interfere with those measures.

If Nightcloud determines that a person does not satisfy the applicable minimum-age requirement for the Service, Nightcloud will promptly restrict or terminate that person’s access.

Information associated with the account will be handled in accordance with our Privacy Policy, applicable law, retention requirements, and any applicable preservation obligation.

7. Hosted AI Safeguards

The Hosted Service uses system-level instructions and other technical controls designed to prevent or redirect requests involving prohibited content, including trafficking, sexual exploitation, child sexual exploitation, coercion, prostitution, and unlawful commercial sexual activity.

Users must not attempt to defeat those controls through jailbreaks, prompt injection, encoded instructions, euphemisms, character instructions, or other circumvention techniques.

Automated safeguards may not identify every prohibited request or prevent every prohibited output.

If the Service unexpectedly produces content prohibited by our policies, the user must not intentionally continue prompting for that content or use the output to facilitate prohibited activity.

8. Local and Offline Use

The Desktop App may permit Local Content and user-supplied AI models to operate entirely on a user’s device.

Nightcloud does not routinely monitor or inspect Local Content that remains on a user’s device and does not receive that content merely because the user operates the Desktop App, unless a particular feature expressly provides otherwise.

That architectural limitation does not make trafficking, exploitation, child sexual exploitation, or other prohibited activity permissible.

If reliable information establishes that a user has violated this Policy through Local Content or use of the Desktop App, Nightcloud may take account-level or other enforcement action available to it.

9. Reports of Suspected Trafficking or Exploitation

Any person may report suspected human trafficking, sex trafficking, child sexual exploitation, coercion, prostitution, unlawful commercial sexual activity, or related exploitation by emailing:

A KinkzAI account is not required to submit a report.

Where reasonably available, please provide:

• a description of the suspected conduct;
• the account, character, content, or activity involved;
• the approximate date and time;
• whether a person may be in immediate danger;
• whether the matter involves a person who is or may be under 18;
• any information indicating force, fraud, coercion, threats, blackmail, commercial sexual activity, exploitation, or third-party control;
• information reasonably sufficient to identify relevant material or activity;
• screenshots or other supporting information that may lawfully and safely be provided; and
• your contact information, if you wish to receive a response.

Do not email or attach suspected CSAM.

Do not undertake an investigation or confront a suspected trafficker in a manner that could place you or another person at risk.

10. Priority Handling of Trafficking and Exploitation Reports

Nightcloud treats reports involving suspected human trafficking, sex trafficking, child sexual exploitation, coercion, or commercial sexual exploitation as priority matters.

Nightcloud reviews and resolves those reports in accordance with our Complaints and Appeals Policy.

Priority handling may include immediate restriction of an account or feature, preservation of available information, escalation for legal or safety review, or other protective action before Nightcloud completes its review.

11. Investigation and Enforcement

When Nightcloud receives reliable information reasonably indicating possible trafficking, exploitation, coercion, or related prohibited conduct, Nightcloud may investigate and take action based on the nature and severity of the risk and the information available to it.

Depending on the circumstances, Nightcloud may:

• restrict, suspend, or terminate an account;
• block or restrict a Hosted Service generation or feature;
• modify, disable, or remove KinkzAI-supplied content within Nightcloud’s control;
• review complaint materials, account information, relevant technical records, age-verification status information, payment-related records, and other information lawfully available to Nightcloud;
• preserve information when required by applicable law, valid legal process, or another applicable preservation obligation;
• take reasonable measures to prevent a terminated user from evading enforcement;
• escalate the matter for legal, safety, or compliance review;
• make reports required by applicable law;
• cooperate with valid legal process; or
• take other action reasonably necessary to protect potential victims, users, Nightcloud, service providers, payment processors, card networks, or third parties.

Nightcloud may take immediate protective action before completing an investigation where available information reasonably indicates a material risk of exploitation, harm to a minor, imminent harm, destruction of evidence, or other serious unlawful activity.

12. Treatment of Potential Victims

Nightcloud will distinguish, where reasonably possible based on the information available to it, between a person suspected of perpetrating prohibited conduct and a person who may be a victim of trafficking, coercion, or exploitation.

A person will not be treated as a perpetrator solely because available information indicates that the person may have been trafficked, coerced, or exploited.

A person’s good-faith disclosure that the person was coerced, trafficked, or exploited will not itself constitute a violation of this Policy or serve as an independent basis for adverse enforcement. Nightcloud will consider evidence of coercion or exploitation when evaluating related conduct.

Nightcloud may nevertheless restrict or take other protective action concerning an account associated with a potential victim when reasonably necessary to protect that person, another person, or relevant evidence.

Nothing in this Policy prohibits a potential victim or another person from seeking assistance, reporting suspected exploitation, or providing information in good faith.

Nightcloud is not a victim-services provider. Its role under this Policy is limited to measures within its control, including enforcement, reporting, preservation, cooperation with lawful investigations, and referral to appropriate resources.

13. External Reporting and Cooperation

Nightcloud will make reports to law enforcement, the National Center for Missing & Exploited Children (“NCMEC”), regulators, or other authorities when required by applicable law.

Where applicable law permits voluntary disclosure or reporting, Nightcloud may make an appropriate report based on the seriousness and credibility of the available information.

If Nightcloud obtains actual knowledge of apparent CSAM or other conduct subject to a mandatory reporting requirement, Nightcloud will make the required report and comply with applicable preservation obligations.

Nightcloud will cooperate with valid subpoenas, warrants, court orders, preservation requests, and other lawful process concerning suspected trafficking, child exploitation, or related unlawful conduct.

Official requests from law-enforcement, judicial, regulatory, or other competent government authorities should be submitted in accordance with our Law Enforcement and Government Request Guidelines.

14. Records and Preservation

Nightcloud may maintain records concerning trafficking or exploitation reports, investigations, enforcement actions, supporting materials, external reports, and related communications for legitimate safety, legal, compliance, fraud-prevention, dispute-resolution, and payment-processing purposes.

Records concerning trafficking or exploitation reports and investigations will be retained for as long as reasonably necessary to document Nightcloud’s investigation and enforcement response and to satisfy applicable legal, regulatory, card-network, payment-processing, fraud-prevention, safety, and dispute-resolution requirements.

Nightcloud will retain information for a longer period when required by applicable law, valid legal process, a preservation obligation, or legal hold. This includes materials subject to preservation requirements associated with a report to NCMEC.

When information is no longer reasonably necessary for those purposes, Nightcloud may delete or de-identify it in accordance with our Privacy Policy and applicable law.

This section does not mean that Nightcloud maintains a server-side archive of Hosted Service conversations or routinely collects Local Content.

Our Privacy Policy provides additional information concerning the retention and disclosure of personal information.

15. Retaliation and Interference

You must not retaliate against, threaten, intimidate, harass, blackmail, extort, or otherwise harm a person because that person:

• reported suspected trafficking or exploitation;
• sought assistance;
• cooperated with an investigation;
• provided information to Nightcloud, law enforcement, a regulator, or a safety organization; or
• exercised rights under applicable law or KinkzAI policies.

You must not attempt to conceal, destroy, falsify, or manipulate information for purposes of interfering with a trafficking or exploitation investigation.

Nightcloud may suspend or terminate an account involved in retaliation or interference.

16. Assistance for Potential Victims

If you or another person is in immediate danger, contact the emergency services available where you are located.

In the United States, the National Human Trafficking Hotline provides assistance to victims, survivors, and other persons seeking help or reporting potential trafficking:

Users outside the United States should contact appropriate emergency services, law-enforcement authorities, or trafficking-support organizations available in their jurisdiction.

KinkzAI is not an emergency service and cannot dispatch emergency assistance.

17. Relationship to Other Policies

This Policy supplements our Terms of Service, Content and Acceptable Use Policy, Content Moderation Policy, Complaints and Appeals Policy, Age Verification Policy, Privacy Policy, AI Companion Safety Protocol, and other applicable KinkzAI policies.

Reports may involve more than one policy. For example, a trafficking report may also involve child sexual exploitation, nonconsensual intimate imagery, fraud, threats, or other prohibited conduct.

Nightcloud may evaluate and address a matter under each applicable policy.

The Content and Acceptable Use Policy controls as to whether particular user content or conduct is prohibited.

The Complaints and Appeals Policy controls the procedures and time periods applicable to complaints and appeals.

18. Changes to This Policy

Nightcloud may modify this Policy from time to time to address changes in the Service, applicable law, card-network or payment-processor requirements, or our safety and compliance procedures.

Material changes will apply prospectively and will be communicated as required by applicable law.

The date at the top of this Policy identifies when it was last updated.
